Remove conditions

Remove the conditions on your marriage green card.

If your marriage was less than two years old when your green card was approved, your card is conditional and valid for two years. Form I-751 removes those conditions so you become a full permanent resident.

What Form I-751 is

When a marriage is less than two years old at the time a green card is approved, USCIS issues a conditional green card valid for two years. Form I-751, Petition to Remove Conditions on Residence, converts that into a 10-year permanent resident card.

The goal is to show USCIS that the marriage was entered in good faith — not to obtain an immigration benefit. The evidence is similar in spirit to what you provided for the original marriage-based case: proof that you've built a shared life together.

This is the natural next step after a marriage-based Adjustment of Status. Most couples file jointly, but the law also allows filing with a waiver of the joint-filing requirement in certain situations.

Who files Form I-751

Form I-751 is for conditional permanent residents who got status through marriage. Key points:

  • You have a 2-year conditional green card obtained through marriage to a U.S. citizen or permanent resident.
  • You generally file during the 90-day window before your conditional card expires.
  • Most couples file jointly, with both spouses signing.
  • If you can't file jointly — for example after divorce, the death of your spouse, or abuse — you may request a waiver of the joint-filing requirement.
  • You'll provide ongoing evidence that the marriage is genuine.

Remove conditions questions

When do I file Form I-751?
Joint filers generally file in the 90 days before the conditional green card expires. Waiver requests can often be filed at other times. We don't estimate USCIS processing times — check uscis.gov.
What evidence shows a good-faith marriage?
Typically things like joint leases or mortgages, joint bank and credit accounts, shared bills, insurance naming each other, photos over time, and birth certificates of any children together. You'll get a checklist tailored to your situation.
Can I file if I'm divorced or my spouse passed away?
Possibly, through a waiver of the joint-filing requirement. Divorce, the death of your spouse, and abuse are recognized bases for a waiver. These cases can be sensitive — consider consulting an attorney.
Is this the same as renewing my green card?
No. A conditional card isn't renewed with Form I-90. You remove the conditions with Form I-751, which then leads to a 10-year card.
